นโยบายความเป็นส่วนตัวฉบับนี้อธิบายวิธีที่บริษัท ไพรมอล จำกัด เก็บรวบรวม ใช้ เปิดเผย และคุ้มครองข้อมูลส่วนบุคคล รวมถึงสิทธิของท่านเกี่ยวกับข้อมูลส่วนบุคคลของท่าน ตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (ค.ศ. 2019) (Personal Data Protection Act หรือ PDPA)

1. เกี่ยวกับเรา

บริษัท ไพรมอล จำกัด (Primal Co., Ltd.) เลขทะเบียนนิติบุคคล 0115558019262 เป็นผู้ควบคุมข้อมูลส่วนบุคคลสำหรับข้อมูลส่วนบุคคลที่กล่าวถึงในนโยบายนี้ ในนโยบายนี้ คำว่า “Primal” และ “เรา” หมายถึงบริษัท ไพรมอล จำกัด

สำนักงานของเราตั้งอยู่ที่เลขที่ 29 อาคารวานิสสา ทาวเวอร์ B ชั้น 14 ซอยชิดลม ถนนเพลินจิต แขวงลุมพินี เขตปทุมวัน กรุงเทพฯ 10330

เราเป็นเอเจนซี่การตลาด ให้บริการแก่ธุรกิจด้านการค้นหา (Search) การค้นหาด้วยปัญญาประดิษฐ์ (Artificial Intelligence หรือ AI Search) การโฆษณา โซเชียลมีเดีย และกลยุทธ์ บริษัท ไพรมอล จำกัด เป็นส่วนหนึ่งของกลุ่ม Primal ซึ่งมีสำนักงาน 3 แห่งในเอเชียตะวันออกเฉียงใต้

สำหรับเรื่องเกี่ยวกับข้อมูลส่วนบุคคล โปรดติดต่อเราทางอีเมล hello@prml.com หรือตามช่องทางในข้อ 16 (ติดต่อเรา) ในกรณีที่ PDPA กำหนดให้เราต้องแต่งตั้งเจ้าหน้าที่คุ้มครองข้อมูลส่วนบุคคล (Data Protection Officer หรือ DPO) เราจะแจ้งช่องทางติดต่อเจ้าหน้าที่ดังกล่าวไว้ในหน้านี้

2. ขอบเขตของนโยบายนี้

นโยบายนี้ครอบคลุมข้อมูลส่วนบุคคลของบุคคลต่อไปนี้ ซึ่งเราประมวลผลในการดำเนินธุรกิจของเรา

• ผู้เข้าชมเว็บไซต์ www.primal.co.th

• ผู้ที่ติดต่อเราหรือส่งคำถามถึงเรา

• ผู้ติดต่อของลูกค้าปัจจุบันและลูกค้าที่อาจเป็นลูกค้าในอนาคต

• ผู้สมัครงานกับเรา

• ผู้ติดต่อของผู้ขายสินค้าหรือผู้ให้บริการแก่เรา

• ผู้สมัครรับจดหมายข่าวของเรา

เมื่อเราประมวลผลข้อมูลส่วนบุคคลในนามของลูกค้าเพื่อให้บริการ เช่น รายชื่อลูกค้าของลูกค้าหรือกลุ่มเป้าหมายโฆษณา ลูกค้าเป็นผู้ควบคุมข้อมูลส่วนบุคคล และเราเป็นผู้ประมวลผลข้อมูลส่วนบุคคลให้ลูกค้า (มาตรา 40 ของ PDPA) นโยบายความเป็นส่วนตัวของลูกค้าใช้กับข้อมูลส่วนบุคคลนั้น และสัญญาระหว่างเรากับลูกค้ากำหนดวิธีที่เราดูแลข้อมูลดังกล่าว

เว็บไซต์และบริการของเราจัดทำขึ้นสำหรับธุรกิจ เราไม่มีเจตนาเก็บรวบรวมข้อมูลส่วนบุคคลของบุคคลที่อายุต่ำกว่า 20 ปี ซึ่งเป็นผู้เยาว์ตามกฎหมายไทย ตามมาตรา 20 ของ PDPA ความยินยอมสำหรับผู้เยาว์ที่อายุไม่เกิน 10 ปีต้องได้รับจากผู้ใช้อำนาจปกครอง และผู้เยาว์ที่อายุมากกว่านั้นต้องได้รับความยินยอมจากผู้ใช้อำนาจปกครองด้วย เว้นแต่กฎหมายให้ผู้เยาว์ให้ความยินยอมได้เอง หากเราทราบว่าได้เก็บรวบรวมข้อมูลส่วนบุคคลของผู้เยาว์โดยไม่ได้รับความยินยอมตามที่ PDPA กำหนด เราจะลบข้อมูลนั้น

นโยบายนี้ไม่ครอบคลุมเว็บไซต์อื่นที่เราลิงก์ไป เช่น เว็บไซต์รับสมัครงาน YouTube LINE หรือเพจโซเชียลมีเดียของเรา ซึ่งใช้นโยบายความเป็นส่วนตัวของเว็บไซต์นั้นเอง

3. ข้อมูลส่วนบุคคลที่เราเก็บรวบรวม

ข้อมูลส่วนบุคคลที่เราเก็บรวบรวมขึ้นอยู่กับการติดต่อระหว่างท่านกับเรา ซึ่งอาจรวมถึงข้อมูลต่อไปนี้

• ข้อมูลติดต่อ

  ชื่อ อีเมลบริษัท หมายเลขโทรศัพท์และรหัสประเทศ และชื่อบริษัทของท่าน

• รายละเอียดคำถาม

  ตัวเลือกที่ท่านเลือกในช่อง “How Can We Help?” ที่อยู่เว็บไซต์ของบริษัท ขนาดบริษัท และข้อมูลอื่นที่ท่านแจ้งเราผ่านแบบฟอร์ม อีเมล โทรศัพท์ ข้อความทาง LINE หรือการประชุม

• การสมัครรับจดหมายข่าว

  อีเมลของท่าน

• ข้อมูลลูกค้าและผู้ให้บริการ

  ข้อมูลติดต่อทางธุรกิจของบุคคลที่เราทำงานด้วย การติดต่อสื่อสารกับบุคคลเหล่านั้น สัญญา ใบเสนอราคา ใบแจ้งหนี้ เอกสารภาษี และหลักฐานการชำระเงิน

• การสมัครงาน

  ข้อมูลที่ท่านให้ไว้ในใบสมัคร เช่น ประวัติการทำงาน คุณวุฒิ และข้อมูลติดต่อ

• ข้อมูลการใช้งานเว็บไซต์

  หมายเลขที่อยู่เครือข่ายของอุปกรณ์ (IP address) ประเภทอุปกรณ์และเบราว์เซอร์ หน้าที่ท่านเข้าชมและเวลาที่ใช้ในแต่ละหน้า เว็บไซต์หรือโฆษณาที่ท่านคลิกมา (รวมถึงรหัสการคลิกโฆษณาและแท็กแคมเปญในที่อยู่หน้าเว็บ) ตำแหน่งโดยประมาณที่คำนวณจากหมายเลขที่อยู่เครือข่าย และรหัสของคุกกี้ ดูข้อ 9 (คุกกี้และการวิเคราะห์ข้อมูล)

เราไม่ขอข้อมูลส่วนบุคคลที่มีความอ่อนไหวผ่านเว็บไซต์นี้ ตามมาตรา 26 ของ PDPA ข้อมูลส่วนบุคคลที่มีความอ่อนไหวรวมถึงเชื้อชาติ เผ่าพันธุ์ ความคิดเห็นทางการเมือง ความเชื่อในลัทธิ ศาสนาหรือปรัชญา พฤติกรรมทางเพศ ประวัติอาชญากรรม ข้อมูลสุขภาพ ความพิการ ข้อมูลสหภาพแรงงาน ข้อมูลพันธุกรรม และข้อมูลชีวภาพ โปรดอย่าส่งข้อมูลเหล่านี้ให้เรา หากท่านใส่ข้อมูลดังกล่าวไว้ในข้อความหรือใบสมัครงาน เราจะประมวลผลข้อมูลนั้นเฉพาะเมื่อได้รับความยินยอมโดยชัดแจ้งจากท่าน หรือในกรณีอื่นที่มาตรา 26 อนุญาต

4. แหล่งที่มาของข้อมูลส่วนบุคคล

• จากท่านโดยตรง เมื่อท่านกรอกแบบฟอร์มบนเว็บไซต์นี้ ส่งอีเมลหรือโทรหาเรา ส่งข้อความถึงเราทาง LINE พบกับเรา สมัครรับจดหมายข่าว หรือสมัครงาน

• จากนายจ้างหรือเพื่อนร่วมงานของท่าน เมื่อบุคคลเหล่านั้นให้ข้อมูลของท่านแก่เราในฐานะผู้ติดต่อสำหรับโครงการ สัญญา หรือใบแจ้งหนี้

• จากแหล่งข้อมูลทางธุรกิจที่เปิดเผยต่อสาธารณะ เช่น เว็บไซต์ของบริษัทท่าน เมื่อเราเตรียมข้อมูลก่อนประชุมกับบริษัทของท่าน

• จากอุปกรณ์ของท่าน ผ่านคุกกี้และเทคโนโลยีที่คล้ายกัน เมื่อท่านใช้เว็บไซต์นี้ ดูข้อ 9

5. วัตถุประสงค์ในการใช้ข้อมูลส่วนบุคคล

เราใช้ข้อมูลส่วนบุคคลเพื่อวัตถุประสงค์ต่อไปนี้ โดยแต่ละข้อระบุฐานทางกฎหมายตาม PDPA ที่เราใช้

• การตอบคำถาม

  เพื่อตอบคำถามของท่าน และนัดหมายการโทรหรือการประชุมที่ท่านขอ ฐานทางกฎหมาย คือ การดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญา (มาตรา 24(3) ของ PDPA) และประโยชน์โดยชอบด้วยกฎหมายของเราในการตอบผู้ที่ติดต่อเรา (มาตรา 24(5))

• ข้อเสนอและใบเสนอราคา

  เพื่อจัดทำข้อเสนอและใบเสนอราคาให้ลูกค้าที่อาจเป็นลูกค้าในอนาคต ฐานทางกฎหมาย คือ การดำเนินการก่อนเข้าทำสัญญา (มาตรา 24(3)) และประโยชน์โดยชอบด้วยกฎหมายของเรา (มาตรา 24(5))

• การให้บริการ

  เพื่อให้บริการแก่ลูกค้าและติดต่อสื่อสารกับผู้ติดต่อของลูกค้า ฐานทางกฎหมาย คือ การปฏิบัติตามสัญญา (มาตรา 24(3)) และสำหรับบุคคลที่ทำงานให้ลูกค้าของเรา คือ ประโยชน์โดยชอบด้วยกฎหมายของเราในการดำเนินงานตามสัญญา (มาตรา 24(5))

• การทำงานกับผู้ให้บริการ

  เพื่อซื้อบริการจากผู้ให้บริการและดูแลการติดต่อกับผู้ให้บริการเหล่านั้น ฐานทางกฎหมาย คือ สัญญา (มาตรา 24(3)) และประโยชน์โดยชอบด้วยกฎหมายของเรา (มาตรา 24(5))

• ใบแจ้งหนี้ การชำระเงิน และการเก็บเอกสาร

  เพื่อออกใบแจ้งหนี้และเอกสารภาษี รับและชำระเงิน และเก็บเอกสารทางธุรกิจ บัญชี และภาษี ฐานทางกฎหมาย คือ สัญญา (มาตรา 24(3)) และหน้าที่ตามกฎหมายบัญชีและภาษี (มาตรา 24(6))

• จดหมายข่าวและข่าวสาร

  เพื่อส่งจดหมายข่าวและข่าวสารเกี่ยวกับบริการของเราให้ผู้ที่ตกลงรับ (การตลาดแบบตรง) ฐานทางกฎหมาย คือ ความยินยอมของท่าน (มาตรา 19)

• การรับสมัครงาน

  เพื่อพิจารณาใบสมัครงานและรับพนักงาน ฐานทางกฎหมาย คือ การดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญาจ้างงาน (มาตรา 24(3)) และประโยชน์โดยชอบด้วยกฎหมายของเรา (มาตรา 24(5))

• การดูแลและวัดผลเว็บไซต์

  เพื่อดูแล รักษาความปลอดภัย และปรับปรุงเว็บไซต์นี้ และเพื่อวัดผลการใช้งานของผู้เข้าชมและดูว่าโฆษณาใดของเรานำมาซึ่งคำถาม ฐานทางกฎหมาย คือ ประโยชน์โดยชอบด้วยกฎหมายของเรา (มาตรา 24(5)) และความยินยอมของท่านในกรณีที่กฎหมายกำหนดให้คุกกี้นั้นต้องได้รับความยินยอม (ดูข้อ 9)

• หน้าที่ตามกฎหมายและการใช้สิทธิเรียกร้อง

  เพื่อปฏิบัติตามหน้าที่ตามกฎหมาย และเพื่อก่อตั้ง ใช้ หรือยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย ฐานทางกฎหมาย คือ หน้าที่ตามกฎหมาย (มาตรา 24(6)) และประโยชน์โดยชอบด้วยกฎหมายของเรา (มาตรา 24(5))

ในกรณีที่เราใช้ฐานประโยชน์โดยชอบด้วยกฎหมาย เราได้ชั่งน้ำหนักประโยชน์นั้นกับสิทธิและเสรีภาพของท่านแล้ว และท่านมีสิทธิคัดค้านได้ (ดูข้อ 14)

เราใช้ข้อมูลส่วนบุคคลเฉพาะตามวัตถุประสงค์เหล่านี้ หากเราต้องการใช้เพื่อวัตถุประสงค์อื่น เราจะแจ้งท่านก่อน และขอความยินยอมจากท่านในกรณีที่ PDPA กำหนด (มาตรา 21)

6. ท่านต้องให้ข้อมูลส่วนบุคคลหรือไม่

การให้ข้อมูลส่วนบุคคลแก่เราเป็นไปโดยสมัครใจ เว้นแต่กฎหมายหรือสัญญากำหนดไว้ ข้อมูลบางอย่างจำเป็นสำหรับวัตถุประสงค์เฉพาะ และหากท่านไม่ให้ข้อมูลนั้น เราจะไม่สามารถดำเนินการตามวัตถุประสงค์นั้นได้

• แบบฟอร์มติดต่อของเราขอชื่อ อีเมลบริษัท และหมายเลขโทรศัพท์ (และในแบบฟอร์ม Get Started ขอให้ระบุเรื่องที่ต้องการให้เราช่วย) หากไม่มีข้อมูลเหล่านี้ เราจะไม่สามารถตอบคำถามของท่านได้ ช่องอื่นไม่บังคับกรอก

• ลูกค้าและผู้ให้บริการต้องให้ข้อมูลติดต่อ ข้อมูลการเรียกเก็บเงิน และข้อมูลภาษีแก่เรา หากไม่มีข้อมูลเหล่านี้ เราจะไม่สามารถเข้าทำหรือปฏิบัติตามสัญญา หรือออกเอกสารภาษีตามที่กฎหมายกำหนดได้

• ผู้สมัครงานต้องให้ข้อมูลตามที่เว็บไซต์รับสมัครงานของเรากำหนด หากไม่มีข้อมูลเหล่านี้ เราจะไม่สามารถพิจารณาใบสมัครได้

• ท่านต้องให้อีเมลแก่เราเพื่อรับจดหมายข่าว

• การปิดกั้นคุกกี้ไม่ทำให้ท่านใช้เว็บไซต์นี้ไม่ได้

7. ผู้ที่เราเปิดเผยข้อมูลส่วนบุคคลให้

เราเปิดเผยข้อมูลส่วนบุคคลเฉพาะแก่ผู้รับประเภทต่อไปนี้ และเฉพาะเท่าที่ผู้รับแต่ละรายจำเป็นต้องใช้ตามวัตถุประสงค์ในนโยบายนี้

• บริษัทในกลุ่ม Primal

  บริษัทอื่นในกลุ่ม Primal ในมาเลเซียและสิงคโปร์ ซึ่งทำงานร่วมกับเราในโครงการของลูกค้า การรับสมัครงาน และงานบริหาร กลุ่ม Primal ใช้ระบบบริหารลูกค้าสัมพันธ์ (Customer Relationship Management หรือ CRM) ระบบเดียวกัน คือ HubSpot พนักงานของบริษัทเหล่านี้จึงเห็นคำถามและข้อมูลผู้ติดต่อของลูกค้าได้

• ผู้ให้บริการ

  บริษัทที่ประมวลผลข้อมูลส่วนบุคคลในนามของเราในฐานะผู้ประมวลผลข้อมูลส่วนบุคคล เช่น บริการโฮสต์และความปลอดภัยของเว็บไซต์ (Cloudflare) อีเมลและซอฟต์แวร์สำนักงาน (Microsoft 365) พื้นที่จัดเก็บข้อมูลบนคลาวด์ (Google Drive) ระบบ CRM ของเรา (HubSpot) การวิเคราะห์ข้อมูลเว็บไซต์ (Google Analytics และ Google Tag Manager) และเว็บไซต์รับสมัครงานของเรา (BrioHR) ผู้ประมวลผลข้อมูลส่วนบุคคลของเราต้องดำเนินการตามคำสั่งของเราเท่านั้นและต้องรักษาความปลอดภัยของข้อมูลส่วนบุคคล (มาตรา 40 ของ PDPA)

• แพลตฟอร์มโฆษณาและการตลาด

  แพลตฟอร์มที่เราใช้ทำแคมเปญให้ลูกค้า ในกรณีที่พนักงานของลูกค้าต้องเข้าถึงบัญชีโฆษณาของลูกค้าเอง

  แพลตฟอร์มโฆษณาที่วัดผลโฆษณาของเราเอง ได้แก่ Google, Meta, LinkedIn, TikTok และ OpenAI เมื่อท่านส่งแบบฟอร์มบนเว็บไซต์นี้ แท็กของแพลตฟอร์มเหล่านี้อาจแจ้งแพลตฟอร์มว่ามีการส่งคำถาม เพื่อให้เราเห็นว่าโฆษณาใดของเรานำมาซึ่งคำถาม Google, Meta และ TikTok อาจได้รับอีเมลและหมายเลขโทรศัพท์ของท่าน และ Meta อาจได้รับชื่อของท่านด้วย ในรูปแบบที่แปลงเป็นรหัสแล้ว (hashed) เพื่อจับคู่คำถามกับการคลิกโฆษณา

• ที่ปรึกษาวิชาชีพ

  ทนายความ นักบัญชี (รวมถึงผู้สอบบัญชีรับอนุญาตที่ตรวจงบการเงินประจำปีของเรา) ที่ปรึกษาด้านภาษี และบริษัทประกันภัยของเรา

• ธนาคารและผู้ให้บริการชำระเงิน

  เพื่อรับและชำระเงิน

• หน่วยงานของรัฐ

  หน่วยงานของรัฐ หน่วยงานกำกับดูแล ศาล และหน่วยงานบังคับใช้กฎหมาย เช่น กรมสรรพากร ในกรณีที่กฎหมายกำหนดหรืออนุญาตให้เปิดเผย

• ผู้ซื้อหรือผู้ลงทุน

  ผู้ซื้อหรือผู้ลงทุนในธุรกิจของเราทั้งหมดหรือบางส่วน หากมีการขายหรือปรับโครงสร้างธุรกิจของเรา

เราไม่ขายข้อมูลส่วนบุคคล

8. การส่งหรือโอนข้อมูลส่วนบุคคลไปต่างประเทศ

เราแบ่งปันข้อมูลส่วนบุคคลกับบริษัทในกลุ่ม Primal ในมาเลเซียและสิงคโปร์ ผู้ให้บริการบางรายของเราและแพลตฟอร์มโฆษณาในข้อ 7 รวมถึง Google, Microsoft, HubSpot, Cloudflare, Meta, LinkedIn, TikTok และ OpenAI อาจจัดเก็บหรือประมวลผลข้อมูลส่วนบุคคลนอกประเทศไทย

มาตรา 28 ของ PDPA อนุญาตให้เราส่งหรือโอนข้อมูลส่วนบุคคลไปยังประเทศอื่นได้ หากประเทศนั้นมีมาตรฐานการคุ้มครองข้อมูลส่วนบุคคลที่เพียงพอตามหลักเกณฑ์ที่คณะกรรมการคุ้มครองข้อมูลส่วนบุคคล (Personal Data Protection Committee หรือ PDPC) กำหนด

หากประเทศปลายทางไม่มีมาตรฐานที่เพียงพอ เราจะส่งหรือโอนข้อมูลส่วนบุคคลเฉพาะในกรณีที่ PDPA อนุญาต ได้แก่ เมื่อมีมาตรการคุ้มครองที่เหมาะสมตามมาตรา 29 และประกาศของ PDPC เช่น ข้อกำหนดด้านการคุ้มครองข้อมูลในสัญญากับผู้ให้บริการ เมื่อการโอนจำเป็นเพื่อปฏิบัติตามสัญญากับท่านหรือเพื่อดำเนินการตามคำขอของท่านก่อนเข้าทำสัญญา หรือเมื่อท่านให้ความยินยอมหลังจากที่เราแจ้งท่านแล้วว่ามาตรฐานของประเทศปลายทางอาจไม่เพียงพอ (มาตรา 28) ในกรณีที่เราต้องอาศัยความยินยอมของท่าน เราจะขอความยินยอมจากท่าน

9. คุกกี้และการวิเคราะห์ข้อมูล

คุกกี้คือไฟล์ขนาดเล็กที่เว็บไซต์จัดเก็บไว้ในอุปกรณ์ของท่าน เพื่อให้เว็บไซต์จดจำอุปกรณ์ของท่านได้เมื่อท่านกลับมาอีกครั้ง เครื่องมือบางรายการด้านล่างใช้เทคโนโลยีที่คล้ายกัน เช่น โค้ดขนาดเล็ก (แท็ก) ที่ส่งข้อมูลไปยังเจ้าของเครื่องมือ

เราใช้ Google Analytics ซึ่งเป็นบริการของ Google เพื่อวัดผลการใช้งานเว็บไซต์ของผู้เข้าชม เช่น หน้าที่เข้าชมและช่องทางที่เข้ามา Google Analytics ตั้งคุกกี้และได้รับหมายเลขที่อยู่เครือข่าย ข้อมูลอุปกรณ์และเบราว์เซอร์ และหน้าที่ท่านเข้าชม เราโหลด Google Analytics ผ่าน Google Tag Manager ซึ่งเป็นเครื่องมือของ Google สำหรับจัดการโค้ดวัดผลบนหน้าเว็บของเรา และข้อมูลบางส่วนอาจผ่านเซิร์ฟเวอร์แท็กของเราเอง (tag.primal.co.th) ก่อนส่งถึง Google

แบบฟอร์มของเราส่งข้อมูลที่ท่านกรอกไปยัง HubSpot ซึ่งเป็นระบบ CRM ของเรา โค้ดติดตามของ HubSpot ในทุกหน้าตั้งคุกกี้ที่เชื่อมการเข้าชมเว็บไซต์นี้ของท่านกับคำถามที่ท่านส่งมา

ผ่าน Google Tag Manager เรายังโหลดแท็กโฆษณาของ Google Ads, Meta, LinkedIn, TikTok และ OpenAI รวมถึง Microsoft Clarity แท็กโฆษณาตั้งคุกกี้ที่บอกเราว่าการเข้าชมจากโฆษณาของเรานำไปสู่การส่งคำถามเมื่อใด แพลตฟอร์มเหล่านี้ประมวลผลข้อมูลดังกล่าวตามนโยบายความเป็นส่วนตัวของตนเอง ส่วน Clarity บันทึกการเลื่อนหน้าจอและการคลิกของผู้เข้าชมในหน้าเว็บ เพื่อให้เราปรับปรุงหน้าเว็บได้

เรายังโหลด GrowthBook ซึ่งเป็นเครื่องมือที่แสดงหน้าเว็บหลายแบบเพื่อให้เราเปรียบเทียบกัน และ BugHerd ซึ่งเป็นเครื่องมือที่ทีมของเราใช้บันทึกความเห็นบนหน้าเว็บระหว่างการปรับปรุงหน้าเว็บ เครื่องมือทั้งสองอาจตั้งคุกกี้หรือเก็บรหัสระบุไว้ในเบราว์เซอร์ของท่าน

บางหน้ามีวิดีโอจาก YouTube ซึ่งเป็นบริการของ Google โดยใช้โหมดเพิ่มความเป็นส่วนตัวของ YouTube เมื่อวิดีโอโหลด YouTube จะได้รับข้อมูลทางเทคนิค เช่น หมายเลขที่อยู่เครือข่ายของท่าน Google ดูแลข้อมูลที่ได้รับตามนโยบายความเป็นส่วนตัวของ Google

10. การตลาดแบบตรง

เราส่งจดหมายข่าวและข่าวสารเกี่ยวกับบริการของเราเฉพาะให้ผู้ที่สมัครรับหรือตกลงรับไว้เท่านั้น

ท่านหยุดรับการตลาดแบบตรงได้ทุกเมื่อ โดยคลิกลิงก์ยกเลิกการรับข่าวสารในอีเมลการตลาดฉบับใดก็ได้ หรือเขียนถึงเราที่ hello@prml.com เราจะหยุดส่งโดยไม่ชักช้า (มาตรา 32 ของ PDPA) อีเมลการตลาดทุกฉบับที่เราส่งมีวิธียกเลิกการรับที่ทำได้ง่าย ตามมาตรา 11 ของพระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2550 (ค.ศ. 2007) ที่แก้ไขเพิ่มเติมในปี 2017

11. การรักษาความมั่นคงปลอดภัยของข้อมูลส่วนบุคคล

เราจัดให้มีมาตรการรักษาความมั่นคงปลอดภัยที่เหมาะสม เพื่อป้องกันการสูญหาย การเข้าถึง การใช้ การเปลี่ยนแปลง การแก้ไข หรือการเปิดเผยข้อมูลส่วนบุคคลโดยไม่มีสิทธิหรือโดยมิชอบ และทบทวนมาตรการเหล่านี้เมื่อจำเป็น (มาตรา 37(1) ของ PDPA)

12. ระยะเวลาการเก็บรักษาข้อมูลส่วนบุคคล

เราเก็บข้อมูลส่วนบุคคลไว้เท่าที่จำเป็นสำหรับวัตถุประสงค์ที่เก็บรวบรวมเท่านั้น เอกสารที่กฎหมายกำหนดให้เราต้องเก็บ เช่น เอกสารทางบัญชีและภาษี จะเก็บไว้ตามระยะเวลาที่กฎหมายกำหนด เราอาจเก็บข้อมูลส่วนบุคคลไว้เท่าที่จำเป็นเพื่อก่อตั้ง ใช้ หรือยกขึ้นต่อสู้สิทธิเรียกร้องตามกฎหมาย ภายในอายุความตามกฎหมายไทยด้วย

หากท่านยกเลิกการรับจดหมายข่าว เราจะเก็บอีเมลของท่านไว้ในรายชื่อห้ามส่ง เพื่อไม่ให้ส่งอีเมลถึงท่านอีก

เมื่อเราไม่ต้องใช้ข้อมูลส่วนบุคคลแล้ว เราจะลบ ทำลาย หรือทำให้ข้อมูลเป็นข้อมูลที่ไม่สามารถระบุตัวท่านได้ (มาตรา 37(3) ของ PDPA)

13. การละเมิดข้อมูลส่วนบุคคล

การละเมิดข้อมูลส่วนบุคคล หมายถึง การละเมิดมาตรการรักษาความมั่นคงปลอดภัยที่ทำให้ข้อมูลส่วนบุคคลสูญหาย หรือถูกเข้าถึง ใช้ เปลี่ยนแปลง หรือเปิดเผยโดยไม่มีสิทธิหรือโดยมิชอบ

หากเกิดการละเมิดข้อมูลส่วนบุคคล เราจะแจ้ง สคส. โดยไม่ชักช้า และภายใน 72 ชั่วโมงนับแต่ทราบเหตุเท่าที่จะทำได้ เว้นแต่การละเมิดนั้นไม่มีความเสี่ยงที่จะกระทบต่อสิทธิและเสรีภาพของบุคคล หากการละเมิดมีความเสี่ยงสูงที่จะกระทบต่อสิทธิและเสรีภาพของท่าน เราจะแจ้งเหตุการละเมิดและแนวทางเยียวยาให้ท่านทราบโดยไม่ชักช้าด้วย (มาตรา 37(4) ของ PDPA)

14. สิทธิของท่าน

ตาม PDPA ท่านมีสิทธิเกี่ยวกับข้อมูลส่วนบุคคลของท่านดังต่อไปนี้ ทั้งนี้ สิทธิบางข้อมีเงื่อนไขและข้อยกเว้นตามที่ PDPA กำหนด

• สิทธิเพิกถอนความยินยอม

  ในกรณีที่เราประมวลผลข้อมูลส่วนบุคคลโดยอาศัยความยินยอม ท่านเพิกถอนความยินยอมได้ทุกเมื่อ โดยทำได้ง่ายเช่นเดียวกับการให้ความยินยอม (มาตรา 19) การเพิกถอนไม่กระทบการประมวลผลที่ทำไปแล้วก่อนหน้านั้น หากท่านเพิกถอนความยินยอม เราอาจไม่สามารถให้บริการที่ต้องอาศัยความยินยอมนั้นต่อได้

• สิทธิเข้าถึงและขอรับสำเนา

  ท่านขอเข้าถึงและขอรับสำเนาข้อมูลส่วนบุคคลของท่านได้ และขอให้เราเปิดเผยการได้มาซึ่งข้อมูลส่วนบุคคลที่ท่านไม่ได้ให้ความยินยอมได้ (มาตรา 30)

• สิทธิขอรับและขอให้ส่งโอนข้อมูล

  ท่านขอรับข้อมูลส่วนบุคคลที่ท่านให้ไว้กับเราในรูปแบบที่ใช้งานทั่วไปและอ่านได้ด้วยเครื่องมืออัตโนมัติ และขอให้เราส่งข้อมูลนั้นไปยังผู้ควบคุมข้อมูลส่วนบุคคลรายอื่นได้ หากทำได้ในทางเทคนิค (มาตรา 31)

• สิทธิคัดค้าน

  ท่านคัดค้านการประมวลผลข้อมูลส่วนบุคคลของท่านที่อาศัยฐานประโยชน์โดยชอบด้วยกฎหมายของเราได้ และคัดค้านการประมวลผลเพื่อการตลาดแบบตรงได้ทุกเมื่อ (มาตรา 32)

• สิทธิขอให้ลบหรือทำลายข้อมูล

  ท่านขอให้เราลบ ทำลาย หรือทำให้ข้อมูลส่วนบุคคลของท่านเป็นข้อมูลที่ไม่สามารถระบุตัวท่านได้ เช่น เมื่อเราไม่ต้องใช้ข้อมูลนั้นแล้ว เมื่อท่านเพิกถอนความยินยอมและเราไม่มีฐานทางกฎหมายอื่น หรือเมื่อท่านคัดค้านแล้ว (มาตรา 33)

• สิทธิขอให้ระงับการใช้ข้อมูล

  ท่านขอให้เราระงับการใช้ข้อมูลส่วนบุคคลของท่านได้ เช่น ระหว่างที่เราตรวจสอบคำขอแก้ไขหรือคำคัดค้าน หรือเมื่อข้อมูลนั้นต้องถูกลบแต่ท่านต้องการให้เก็บไว้ (มาตรา 34)

• สิทธิขอให้แก้ไขข้อมูล

  ท่านขอให้เราแก้ไขข้อมูลส่วนบุคคลของท่านให้ถูกต้อง เป็นปัจจุบัน สมบูรณ์ และไม่ก่อให้เกิดความเข้าใจผิดได้ (มาตรา 35 และ 36) โปรดแจ้งเราหากข้อมูลของท่านเปลี่ยนแปลง

• สิทธิร้องเรียน

  ท่านร้องเรียนได้หากเห็นว่าเราไม่ปฏิบัติตาม PDPA (มาตรา 73) ดูย่อหน้าสุดท้ายของข้อนี้

หากต้องการใช้สิทธิข้อใดข้างต้น โปรดเขียนถึงเราที่ hello@prml.com หรือทางไปรษณีย์ (ดูข้อ 16) เราอาจขอให้ท่านยืนยันตัวตนก่อนดำเนินการ เราจะตอบโดยไม่ชักช้าและภายใน 30 วันนับแต่ได้รับคำขอ หากเราไม่สามารถดำเนินการตามคำขอได้ เราจะแจ้งเหตุผลให้ท่านทราบเป็นลายลักษณ์อักษร

15. การเปลี่ยนแปลงนโยบายนี้

เราอาจปรับปรุงนโยบายนี้ และจะเผยแพร่ฉบับใหม่แต่ละฉบับในหน้านี้พร้อมวันที่ หากการเปลี่ยนแปลงกระทบต่อการใช้ข้อมูลส่วนบุคคลที่เราเก็บรวบรวมโดยอาศัยความยินยอมของท่าน เราจะขอความยินยอมจากท่านอีกครั้งในกรณีที่ PDPA กำหนด

1. Who We Are

Primal Co., Ltd. (บริษัท ไพรมอล จำกัด), Corporate Identification No. 0115558019262, is the data controller for the personal data described in this notice. In this notice, “Primal”, “we”, “us” and “our” mean Primal Co., Ltd.

Our office is at 29 Vanissa Building, Tower B, 14th Floor, Soi Chidlom, Ploenchit Road, Lumpini, Pathumwan, Bangkok 10330.

We are a marketing agency. We provide search, artificial intelligence (AI) search, advertising, social media and strategy services to businesses. Primal Co., Ltd. is part of the Primal group, which has 3 offices in Southeast Asia.

For personal data matters, write to us at hello@prml.com or use the details under Contact Us. Where the PDPA requires us to designate a data protection officer, we will give the officer’s contact details on this page.

2. What This Notice Covers

This notice covers personal data about the following people, which we process in the course of our business.

• Visitors to www.primal.co.th.

• People who contact us or send us an enquiry.

• Contact people at our prospective and current clients.

• People who apply for a job with us.

• Contact people at our suppliers.

• People who subscribe to our newsletter.

When we process personal data on behalf of a client to deliver our services, for example a client’s customer lists or advertising audiences, the client is the data controller and we act as its data processor (section 40 of the PDPA). The client’s own privacy notice applies to that personal data, and our agreement with the client sets out how we handle it.

Our website and services are meant for businesses. We do not knowingly collect personal data from anyone under 20 years of age, a minor under Thai law. Under section 20 of the PDPA, consent for a minor under 10 years of age must come from the holder of parental responsibility, and an older minor needs that consent too unless the law allows the minor to give it alone. If we learn that we have collected a minor’s personal data without the consent the PDPA requires, we will delete it.

This notice does not cover other websites that we link to, such as our job board, YouTube, LINE or our social media pages. Their own privacy notices apply.

3. The Personal Data We Collect

The personal data we collect depends on how you deal with us. It can include the following.

• Contact details

  Your name, company email address, phone number and country code, and the name of your company.

• Enquiry details

  What you choose under “How Can We Help?”, your company’s website address, your company size, and anything else you tell us in a form, an email, a phone call, a LINE message or a meeting.

• Newsletter subscription

  Your email address.

• Client and supplier records

  Business contact details of the people we work with, our correspondence with them, contracts, quotations, invoices, tax documents and payment records.

• Job applications

  The details you give in your application, such as your work history, qualifications and contact details.

• Website usage data

  Your device’s network address (IP address), device and browser type, the pages you view and the time you spend on them, the website or ad you came from (including ad click identifiers and campaign tags in the page address), an approximate location worked out from your network address, and cookie identifiers. See Cookies And Analytics.

We do not ask for sensitive personal data through this website. Under section 26 of the PDPA, sensitive personal data includes racial or ethnic origin, political opinions, cult, religious or philosophical beliefs, sexual behaviour, criminal records, health data, disability, trade union information, genetic data and biometric data. Please do not send it to us. If you include it in a message or a job application, we will process it only with your explicit consent or where section 26 otherwise allows.

4. Where We Get Personal Data

• From you, when you fill in a form on this website, email or call us, message us on LINE, meet us, subscribe to our newsletter or apply for a job.

• From your employer or colleagues, when they give us your details as a contact for a project, a contract or an invoice.

• From publicly available business sources, such as your company’s website, when we prepare for a meeting with your company.

• From your device, through cookies and similar technologies, when you use this website. See Cookies And Analytics.

5. Why We Use Personal Data

We use personal data for the following purposes. After each purpose is the legal basis we rely on under the PDPA.

• Replying to enquiries

  To reply to your enquiry and arrange the calls or meetings you ask for. We rely on taking the steps you ask for before a contract (section 24(3) of the PDPA) and on our legitimate interest in answering people who contact us (section 24(5)).

• Proposals and quotations

  To prepare proposals and quotations for prospective clients. We rely on taking steps before a contract (section 24(3)) and on our legitimate interests (section 24(5)).

• Delivering our services

  To deliver our services to clients and communicate with their contact people. We rely on performing our contract (section 24(3)) and, for the people who work for our clients, on our legitimate interest in running the engagement (section 24(5)).

• Working with suppliers

  To buy services from suppliers and manage our dealings with them. We rely on the contract (section 24(3)) and on our legitimate interests (section 24(5)).

• Invoices, payments and records

  To issue invoices and tax documents, collect and make payments, and keep business, accounting and tax records. We rely on the contract (section 24(3)) and on our legal obligations under accounting and tax laws (section 24(6)).

• Newsletter and news

  To send our newsletter and news about our services to people who have agreed to receive them (direct marketing). We rely on your consent (section 19).

• Recruitment

  To assess job applications and recruit staff. We rely on taking the steps you ask for before an employment contract (section 24(3)) and on our legitimate interests (section 24(5)).

• Running and measuring this website

  To run, secure and improve this website, and to measure how visitors use it and which of our ads bring enquiries. We rely on our legitimate interests (section 24(5)), and on your consent where the law requires it for a cookie (see Cookies And Analytics).

• Legal obligations and claims

  To comply with our legal obligations, and to establish, exercise or defend legal claims. We rely on our legal obligations (section 24(6)) and on our legitimate interests (section 24(5)).

Where we rely on our legitimate interests, we have weighed them against your rights and freedoms, and you can object (see Your Rights).

We use personal data only for these purposes. If we want to use it for another purpose, we will tell you first and ask for your consent where the PDPA requires it (section 21).

6. Whether You Must Give Us Personal Data

Giving us personal data is voluntary unless a law or a contract requires it. Some personal data is needed for a particular purpose, and if you do not give it, we cannot complete that purpose.

• Our contact forms ask for your name, company email and phone number (and, in the Get Started form, how we can help). Without these, we cannot reply to your enquiry. The other fields are optional.

• Clients and suppliers need to give us contact, billing and tax details. Without them, we cannot enter into or perform the contract, or issue the tax documents the law requires.

• Job applicants need to give the details our job board asks for. Without them, we cannot consider the application.

• To receive our newsletter, you need to give us your email address.

• Blocking cookies does not stop you from using this website.

7. Who We Disclose Personal Data To

We disclose personal data only to the following categories of recipients, and only as far as each needs it for the purposes in this notice.

• Primal group companies

  Other companies in the Primal group in Malaysia and Singapore, which work with us on client projects, recruitment and administration. The group uses one customer relationship management system (HubSpot), so staff in these companies can see enquiries and client contacts.

• Service providers

  Companies that process personal data on our behalf as data processors, for example for website hosting and security (Cloudflare), email and office software (Microsoft 365), cloud storage (Google Drive), our customer relationship management system (HubSpot), website analytics (Google Analytics and Google Tag Manager) and our job board (BrioHR). Our data processors must act only on our instructions and keep personal data secure (section 40 of the PDPA).

• Advertising and marketing platforms

  Platforms we use to run a client’s campaigns, where the client’s staff need access to the client’s own advertising accounts.

  Advertising platforms that measure our own ads: Google, Meta, LinkedIn, TikTok and OpenAI. When you send a form on this website, their tags may tell them that an enquiry was sent, so we can see which of our ads bring enquiries. Google, Meta and TikTok may also receive your email address and phone number, and Meta your first name, in hashed form (turned into a code), so they can match the enquiry to an ad click.

• Professional advisers

  Our lawyers, accountants (including the certified public accountant who reviews our annual accounts), tax advisers and insurers.

• Banks and payment providers

  To make and receive payments.

• Authorities

  Government authorities, regulators, courts and law enforcement agencies, such as the Revenue Department, where the law requires or allows the disclosure.

• Buyers or investors

  A buyer of, or investor in, all or part of our business, if our business is sold or restructured.

We do not sell personal data.

8. Transfers Outside Thailand

We share personal data with the companies in the Primal group in Malaysia and Singapore. Some of our service providers and the advertising platforms in section 7, including Google, Microsoft, HubSpot, Cloudflare, Meta, LinkedIn, TikTok and OpenAI, may store or process personal data outside Thailand.

Section 28 of the PDPA allows us to send or transfer personal data to another country where that country has adequate personal data protection standards under the criteria set by the Personal Data Protection Committee (PDPC).

Where it does not, we transfer personal data only where the PDPA allows it: where the safeguards that section 29 and the PDPC’s notifications accept are in place, such as data protection terms in our contracts with service providers; where the transfer is necessary to perform a contract with you or to take steps you ask for before a contract; or where you have given your consent after we told you that the destination’s standards may not be adequate (section 28). Where we rely on your consent, we will ask you for it.

9. Cookies And Analytics

Cookies are small files that a website stores on your device. They let the website recognise your device when you return. Some of the tools below use similar technologies, such as small pieces of code (tags) that send data to the tool’s owner.

We use Google Analytics, a service from Google, to measure how visitors use this website, for example which pages they view and how they arrived. Google Analytics sets cookies and receives your network address, your device and browser details and the pages you view. We load Google Analytics through Google Tag Manager, a Google tool that manages the measurement code on our pages, and some of this data may pass through our own tagging server (tag.primal.co.th) before it reaches Google.

Our forms send what you enter to HubSpot, our customer relationship management system. The HubSpot tracking code on every page sets cookies that connect your visits to this website with your enquiry.

Through Google Tag Manager we also load advertising tags from Google Ads, Meta, LinkedIn, TikTok and OpenAI, and Microsoft Clarity. The advertising tags set cookies that tell us when a visit from one of our ads leads to an enquiry. The platforms process this data under their own privacy policies. Clarity records how visitors scroll and click on a page, so we can improve it.

We also load GrowthBook, a tool that shows different versions of a page so we can compare them, and BugHerd, a tool our team uses to leave notes on pages while we work on them. Both may set cookies or store an identifier in your browser.

Some pages show videos from YouTube, a Google service, in YouTube’s privacy-enhanced mode. When a video loads, YouTube receives technical data such as your network address. Google handles the data it receives under its own privacy policy.

We use the cookies this website needs to work, and Cloudflare Turnstile on our forms (see How We Protect Personal Data), because we need them to run and protect the website (section 24(5) of the PDPA). We use the analytics and advertising tools above on the basis of our legitimate interest in measuring and improving our website and our ads (section 24(5)). Where the law requires your consent for a cookie, we will ask for it before we set that cookie, and you can withdraw it at any time.

You can object to this use, and you can block or delete cookies in your browser settings. This website still works if you do. You can also stop Google Analytics from measuring your visits with the Google Analytics opt-out browser add-on.

10. Direct Marketing

We send our newsletter and news about our services only to people who have subscribed or otherwise agreed to receive them.

You can stop direct marketing at any time. Use the unsubscribe link in any marketing email, or write to us at hello@prml.com. We will then stop without delay (section 32 of the PDPA). Every marketing email we send gives you an easy way to unsubscribe, in line with section 11 of the Computer Crime Act B.E. 2550 (2007), as amended in 2017.

11. How We Protect Personal Data

We take appropriate security measures to prevent the loss of personal data and its unauthorised or unlawful access, use, change or disclosure, and we review these measures when needed (section 37(1) of the PDPA).

These measures include giving access only to staff who need the personal data for their work, protecting our accounts and systems, and using encrypted connections for this website. Our data processors must also keep personal data secure (section 40).

We use Cloudflare Turnstile on the forms on this website to tell people apart from automated programs and to protect what you send us. Turnstile runs without showing anything on screen. It may process technical data such as your network address and the characteristics of your browser and device. Cloudflare handles this data as described in the Cloudflare Turnstile Privacy Addendum.

12. How Long We Keep Personal Data

We keep personal data only for as long as we need it for the purpose we collected it for. Records that the law requires us to keep, such as accounting and tax records, are kept for the period the law sets. We may also keep personal data for as long as we need it to establish, exercise or defend legal claims, within the limitation periods of Thai law.

If you unsubscribe from our newsletter, we keep your email address on a do-not-send list so that we do not email you again.

When we no longer need personal data, we delete it, destroy it or make it anonymous so that it can no longer identify you (section 37(3) of the PDPA).

13. Personal Data Breaches

A personal data breach is a breach of security that leads to the loss of personal data, or to its unauthorised or unlawful access, use, change or disclosure.

If a personal data breach occurs, we will notify the PDPC Office without delay and, where feasible, within 72 hours after we become aware of it, unless the breach is unlikely to result in a risk to the rights and freedoms of the people affected. If the breach is likely to result in a high risk to your rights and freedoms, we will also tell you about the breach and what we are doing about it without delay (section 37(4) of the PDPA).

14. Your Rights

Under the PDPA, you have the following rights over your personal data. Some of them have conditions and exceptions set out in the PDPA.

• Withdrawing consent

  Where we process personal data with your consent, you can withdraw it at any time, as easily as you gave it (section 19). Withdrawing consent does not affect processing that took place before. If you withdraw consent, we may not be able to continue a service that depends on it.

• Access and copy

  You can ask for access to and a copy of your personal data, and ask us to tell you how we obtained personal data you did not consent to us collecting (section 30).

• Data portability

  You can ask to receive the personal data you gave us in a commonly used, machine-readable format, and ask us to send it to another data controller where that is technically feasible (section 31).

• Objection

  You can object to our processing of your personal data where we rely on our legitimate interests, and at any time to processing for direct marketing (section 32).

• Erasure

  You can ask us to delete, destroy or anonymise your personal data, for example where we no longer need it, where you withdraw your consent and we have no other legal basis, or where you have objected (section 33).

• Restriction

  You can ask us to restrict the use of your personal data, for example while we check a correction request or an objection, or where we would otherwise delete it but you need it kept (section 34).

• Correction

  You can ask us to correct your personal data so that it is accurate, up to date, complete and not misleading (sections 35 and 36). Please tell us if your details change.

• Complaint

  You can make a complaint if you believe we have not complied with the PDPA (section 73). See the last paragraph of this section.

To use any of these rights, write to us at hello@prml.com or by post (see Contact Us). We may ask you to confirm your identity before we act. We reply without delay and within 30 days of receiving your request. If we cannot meet a request, we will tell you why in writing.

A person you authorise in writing can make a request on your behalf, and the holder of parental responsibility can act for a minor. If you give us personal data about another person, such as a colleague, please make sure they know about this notice.

15. Changes To This Notice

We may update this notice. We will publish each new version on this page with its date. If a change affects how we use personal data that we collected with your consent, we will ask for your consent again where the PDPA requires it.
