We are a marketing agency. We provide search, artificial intelligence (AI) search, advertising, social media and strategy services to businesses. Primal Co., Ltd. is part of the Primal group, which has 3 offices in Southeast Asia.

2. Using This Website

You may use this website to learn about Primal and our services, to read our articles and to contact us. You must use it lawfully. In particular, you must not do any of the following.

• Try to gain unauthorised access to the website, its servers or the systems connected to it.

• Send or upload viruses or other harmful code, or do anything that could damage, overload or interrupt the website.

• Send false, misleading, abusive or unlawful content through our forms, or send details in another person’s name without their permission.

• Copy large parts of the website by automated means for a commercial purpose without our written permission. Search engines and AI assistants may read the website as our robots.txt file allows.

Some of these acts may also be offences under the Computer Crime Act B.E. 2550 (2007), as amended.

We may change, suspend or withdraw any part of the website at any time, without notice.

3. Information On This Website

The content of this website is general information about marketing and about our services. It is not professional, legal or financial advice for your business. We take care to keep it accurate and up to date, but it may contain errors or become out of date.

Case studies, reviews and figures on this website describe results for particular clients at particular times. They show what we have done, not what any other business will achieve. Our calculators and other tools give estimates from the numbers you enter, and an estimate is not a promise of any result.

Nothing on this website is an offer to enter into a contract. We give the scope and fees of our services in a written quotation.

4. Our Enquiry Forms

When you send our contact form or our Get Started form, you ask us to contact you about our services. We reply by email or by phone, using the details you give.

Sending a form does not create a contract between you and us, and it does not oblige either of us to enter into one.

By sending a form, you confirm that the details are accurate and that you are allowed to give them, including any details about your company or your colleagues.

Our forms use Cloudflare Turnstile to tell people apart from automated programs. We may ignore a form that appears automated, abusive or unlawful.

We handle the personal data you send as our Privacy Notice explains. Subscribing to our newsletter is optional, and you can unsubscribe at any time.

5. Quotations And Agreements

We provide our services only under a written quotation or agreement that both parties accept. That quotation or agreement, and the terms it refers to, govern the services. Where it differs from these terms, it prevails for that engagement.

A quotation or agreement may be accepted and signed by electronic means, such as an email reply or an electronic signature. Under the Electronic Transactions Act B.E. 2544 (2001), information is not denied legal effect only because it is in electronic form, electronic data can meet a legal requirement for writing, an electronic signature can meet a requirement for a signature, and an offer and its acceptance can be made by electronic data (sections 7, 8, 9 and 13).

Our contracts are governed by the Civil and Commercial Code and the other laws of Thailand, unless the quotation or agreement states otherwise.

6. Performance Guarantees

Our performance guarantees are published on our Guarantees page. They apply to an engagement only where its quotation or agreement states that they are included. These terms do not change them.

7. Intellectual Property

The content of this website, including its text, images, videos, graphics, logos, page design, calculators and other tools, belongs to Primal or to the people who licensed it to us. It is protected by the Copyright Act B.E. 2537 (1994), the Trademark Act B.E. 2534 (1991) and other laws.

You may view the website, print or save pages, and share links to it, for your own information or for your company’s internal use. You may quote short passages with a link to the page they come from. Any other copying, publication, change or commercial use needs our written permission.

Primal, ElevateSEO™ and INSTINCT® are marks of the Primal group. Other names and logos on this website, such as Google, Meta, TikTok, LINE and HubSpot, belong to their owners. We show them to identify their products or our partner status with them.

8. Links To Other Websites

This website links to websites that we do not control, such as our job board, YouTube, LINE, our social media pages and the sources we cite. We are not responsible for their content, their availability or their privacy practices. Their own terms and privacy notices apply.

9. Limitation Of Liability

We provide this website as it is. We do not promise that it will always be available, or that it will be without errors or harmful code.

To the extent the law allows, we are not liable for any loss or damage that comes from using this website, from being unable to use it, or from relying on its content. This includes lost profits, lost revenue and lost business.

Nothing in these terms limits or excludes liability that Thai law does not allow us to limit or exclude. In particular, we do not exclude or limit liability for loss of life, injury or harm to health caused by our wilful act or negligence (section 8 of the Unfair Contract Terms Act B.E. 2540 (1997)), or liability for our fraud or gross negligence (section 373 of the Civil and Commercial Code). Any other limit in these terms applies only as far as it is fair and reasonable in the circumstances (section 8 of the Unfair Contract Terms Act).

Our liability for our services is set out in the quotation or agreement for those services.

10. Privacy

Our Privacy Notice explains how we collect, use, disclose and protect personal data under Thailand’s Personal Data Protection Act B.E. 2562 (2019) (PDPA), and the rights you have.

11. Changes To These Terms

We may update these terms. We will publish each new version on this page with its date. The version on this page when you use the website applies to that use. A change does not alter a quotation or agreement that has already been accepted.

12. Governing Law And Courts

These terms, and any dispute about this website or these terms, are governed by the laws of Thailand. The courts of Thailand have jurisdiction to decide any such dispute.

If a court finds any part of these terms invalid or unenforceable, the rest of these terms stays in effect.

13. Language

These terms are given in English and in Thai. The Thai text says the same things in the same order, written for Thai readers rather than translated word for word. If the two texts differ, the English text governs.

เราเป็นเอเจนซี่การตลาด ให้บริการแก่ธุรกิจด้านการค้นหา (Search) การค้นหาด้วยปัญญาประดิษฐ์ (Artificial Intelligence หรือ AI Search) การโฆษณา โซเชียลมีเดีย และกลยุทธ์ บริษัท ไพรมอล จำกัด เป็นส่วนหนึ่งของกลุ่ม Primal ซึ่งมีสำนักงาน 3 แห่งในเอเชียตะวันออกเฉียงใต้

2. การใช้เว็บไซต์นี้

ท่านใช้เว็บไซต์นี้เพื่อศึกษาข้อมูลเกี่ยวกับ Primal และบริการของเรา อ่านบทความของเรา และติดต่อเราได้ ท่านต้องใช้เว็บไซต์โดยชอบด้วยกฎหมาย และต้องไม่กระทำการต่อไปนี้

• พยายามเข้าถึงเว็บไซต์ เซิร์ฟเวอร์ หรือระบบที่เชื่อมต่อกับเว็บไซต์โดยไม่มีสิทธิ

เมื่อท่านส่งแบบฟอร์มติดต่อหรือแบบฟอร์ม Get Started ถือว่าท่านขอให้เราติดต่อกลับเกี่ยวกับบริการของเรา เราจะติดต่อกลับทางอีเมลหรือโทรศัพท์ตามข้อมูลที่ท่านให้ไว้

การส่งแบบฟอร์มไม่ก่อให้เกิดสัญญาระหว่างท่านกับเรา และไม่ผูกพันให้ฝ่ายใดต้องเข้าทำสัญญา

เมื่อส่งแบบฟอร์ม ท่านยืนยันว่าข้อมูลที่ส่งถูกต้อง และท่านมีสิทธิให้ข้อมูลนั้น รวมถึงข้อมูลเกี่ยวกับบริษัทหรือเพื่อนร่วมงานของท่าน

5. ใบเสนอราคาและสัญญา

เราให้บริการภายใต้ใบเสนอราคาหรือสัญญาที่เป็นลายลักษณ์อักษรซึ่งทั้งสองฝ่ายยอมรับเท่านั้น ใบเสนอราคาหรือสัญญานั้น รวมถึงข้อกำหนดที่อ้างถึงในเอกสารนั้น ใช้บังคับกับบริการ หากแตกต่างจากข้อกำหนดนี้ ให้ใช้ใบเสนอราคาหรือสัญญานั้นสำหรับงานนั้น

การยอมรับและลงนามในใบเสนอราคาหรือสัญญาทำได้ด้วยวิธีการทางอิเล็กทรอนิกส์ เช่น การตอบอีเมลหรือลายมือชื่ออิเล็กทรอนิกส์ ตามพระราชบัญญัติว่าด้วยธุรกรรมทางอิเล็กทรอนิกส์ พ.ศ. 2544 (ค.ศ. 2001) ข้อความจะไม่ถูกปฏิเสธผลทางกฎหมายเพียงเพราะอยู่ในรูปข้อมูลอิเล็กทรอนิกส์ ข้อมูลอิเล็กทรอนิกส์ใช้แทนหนังสือได้ ลายมือชื่ออิเล็กทรอนิกส์ใช้แทนการลงลายมือชื่อได้ และคำเสนอกับคำสนองทำเป็นข้อมูลอิเล็กทรอนิกส์ได้ (มาตรา 7 มาตรา 8 มาตรา 9 และมาตรา 13)

สัญญากับเราอยู่ภายใต้ประมวลกฎหมายแพ่งและพาณิชย์และกฎหมายอื่นของประเทศไทย เว้นแต่ใบเสนอราคาหรือสัญญาจะระบุไว้เป็นอย่างอื่น

6. การรับประกันผลลัพธ์

การรับประกันผลลัพธ์ของเราเผยแพร่ไว้ในหน้าการรับประกันผลลัพธ์ ซึ่งใช้กับงานใดเฉพาะเมื่อใบเสนอราคาหรือสัญญาของงานนั้นระบุว่ารวมการรับประกันไว้ ข้อกำหนดนี้ไม่เปลี่ยนแปลงการรับประกันดังกล่าว

7. ทรัพย์สินทางปัญญา

เนื้อหาบนเว็บไซต์นี้ รวมถึงข้อความ รูปภาพ วิดีโอ กราฟิก โลโก้ การออกแบบหน้าเว็บ เครื่องคำนวณ และเครื่องมืออื่น เป็นของ Primal หรือของผู้ที่อนุญาตให้เราใช้ และได้รับความคุ้มครองตามพระราชบัญญัติลิขสิทธิ์ พ.ศ. 2537 (ค.ศ. 1994) พระราชบัญญัติเครื่องหมายการค้า พ.ศ. 2534 (ค.ศ. 1991) และกฎหมายอื่น

ท่านเข้าชมเว็บไซต์ พิมพ์หรือบันทึกหน้าเว็บ และแชร์ลิงก์ของเว็บไซต์ได้ เพื่อเป็นข้อมูลของท่านเองหรือเพื่อใช้ภายในบริษัทของท่าน ท่านยกข้อความสั้น ๆ ไปอ้างอิงได้โดยใส่ลิงก์กลับมายังหน้าที่มาของข้อความ การคัดลอก เผยแพร่ ดัดแปลง หรือใช้เพื่อการค้าในลักษณะอื่นต้องได้รับอนุญาตเป็นลายลักษณ์อักษรจากเรา

9. การจำกัดความรับผิด

10. ความเป็นส่วนตัว

นโยบายความเป็นส่วนตัวของเราอธิบายวิธีที่เราเก็บรวบรวม ใช้ เปิดเผย และคุ้มครองข้อมูลส่วนบุคคล ตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (ค.ศ. 2019) (Personal Data Protection Act หรือ PDPA) และสิทธิของท่าน

11. การเปลี่ยนแปลงข้อกำหนดนี้

เราอาจปรับปรุงข้อกำหนดนี้ และจะเผยแพร่ฉบับใหม่แต่ละฉบับในหน้านี้พร้อมวันที่ ฉบับที่อยู่ในหน้านี้ขณะที่ท่านใช้เว็บไซต์ใช้กับการใช้งานครั้งนั้น การเปลี่ยนแปลงไม่กระทบใบเสนอราคาหรือสัญญาที่ได้รับการยอมรับไปแล้ว

13. ภาษา

ข้อกำหนดนี้มีทั้งภาษาอังกฤษและภาษาไทย ข้อความภาษาไทยมีเนื้อหาเดียวกันและเรียงลำดับเดียวกัน โดยเขียนสำหรับผู้อ่านชาวไทยแทนการแปลคำต่อคำ หากข้อความสองภาษาไม่ตรงกัน ให้ถือตามภาษาอังกฤษ
